1. “AS IS” Disclaimer
Section titled “1. “AS IS” Disclaimer”The Software, QuickApp modules, scripts, and algorithms provided by ICAS Automation are supplied on an “AS IS” and “AS AVAILABLE” basis, without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, error-free operation, or uninterrupted service.
2. Inactive State and Trial Period
Section titled “2. Inactive State and Trial Period”The User acknowledges that the Software contains built-in license control mechanisms. ICAS Automation bears no liability whatsoever for any damages, energy losses, suboptimal PV surplus management, actuator damage, or system operation interruptions resulting from:
- Automatic transition of the Software into an inactive state following the expiration of the 14-day free trial period.
- Absence of an active and fully paid Full license.
- Transition of the Software into an inactive state due to the inability to perform periodic license verification caused by prolonged lack of internet connectivity on the hub for reasons attributable to the User.
3. Limitation of Liability for Property and Energy Damage
Section titled “3. Limitation of Liability for Property and Energy Damage”To the maximum extent permitted by applicable law, ICAS Automation shall not be held liable for any property damage, direct losses, or lost profits arising out of the use of or inability to use the Software. This limitation of liability specifically covers:
- Damage to actuators, relays, electrical, plumbing, heating, air conditioning installations, energy storage systems, and consumer electronics.
- Property damage (including flooding and overheating) and financial losses resulting from the failure to turn an actuator on or off at the expected time.
- Erroneous control decisions caused by inaccurate energy meter readings, power outages, radio communication interruptions, or excessive contact switching.
- Smart Home system downtime, data loss, and repair costs for third-party equipment.
This limitation of liability does not apply to damages caused by ICAS Automation through willful misconduct.
4. Impact of Runtime Environment and Infrastructure
Section titled “4. Impact of Runtime Environment and Infrastructure”The Software logic executes locally on the central hub; however, it remains dependent on the hardware and system environment of the hub manufacturer. ICAS Automation bears no liability for module malfunctions resulting from:
- Hub firmware updates (Fibaro HC3 / Yubii Home OS).
- Changes to APIs or protocols provided by the hub manufacturer or third parties.
- Signal range and stability issues within Z-Wave, Zigbee, or Wi-Fi networks, or physical damage to sensors and actuators.
5. User Responsibility for Configuration and Parameterization
Section titled “5. User Responsibility for Configuration and Parameterization”The accuracy and safety of algorithm operations depend entirely on the parameters configured by the User (including switch identifier switch_id, power rating switch_pwr, thresholds, and power_on_rule rules). The User assumes full responsibility for verifying and testing algorithm behavior in a safe environment prior to deploying it for automated, continuous operation.
6. Limitation of Financial Liability
Section titled “6. Limitation of Financial Liability”If, for any legal reason, the liability of ICAS Automation is established by a court of competent jurisdiction, the total aggregate financial liability shall be strictly limited to the amount actually paid by the User for the purchase of the respective Software license (or 0.00 PLN in the case of using a trial version or software provided free of charge).
